Groat VS. Random explained...[for F00FBUG] Toaded Player 03/30/01, 07:01

This is an edited log from FurryMUCK of an exchange that occurred in FM's West Corner of the Park on 6/30/99 between Random and Jim Groat
[whose FM character at the time was named Rabbi_Tom]. Groat has pulled this 'I’m quitting the Fandom!' at least two more times before he finally
@toaded [quit] permanently from FurryMUCK in the fall of 2000. All instances of the name 'Rabbi_Tom' have been changed to read 'Jim_Groat' to
make comprehension easier.

Jim_Groat nods... '[I'm] trying to get the 99/Y2K calendar ready... the next WcotP book ready too.'
Random says, 'You're selling the WCotP strips [original artwork], Groat?'
Jim_Groat nods.
Random says, 'Will you be including the strips where you featured me, Groat?'
Jim_Groat nods... 'well...one already is gone.'
Random says, 'So, you'll be making money off my character name and image? How much is my share, eh?'
Jim_Groat says, 'Actually...it came off a trade....markers for artwork.'
Random says, 'You do realize that's illegal, right? Using a copyrighted character which belongs to someone else for your own profit is a pretty big
no-no.'
Seg says, 'Is Random specifially named in any of the strips? :)'
Random says, 'Yes, Seg, I am.'
Ar-PeeDee says, 'Um, Random, I'm no expert, but isn't WCotP editorial content?'
Random says, 'When he sells an image of my character without my permission, it's a violation of copyright law.'
Jim_Groat says, 'Who says I sold it...I traded it.'
Jim_Groat says, 'Random...people have been selling images of my characters for years...only a few pop my cork.'
Random says, 'Same difference. You didn't have my permission to do any such thing with my image.'
Random says, 'Fair is fair. How about I just print up some Red Shetland [a character copyrighted by Groat] tee shirts and sell them?'
Jim_Groat says, 'Okay Random...just to please you...I'll destroy all strips, will that please you?'
Jim_Groat says, 'I'll end the strip just to please you.'
Joseph says, 'Is that a promise???'
Random says, 'Do as you like. I just resent being used without being asked.'
Shadow-Walker notes that Random did have a good point. 'I just gave permission for anyone to use my image, with my button [on my character
description].
Jim_Groat says, 'Fine...Everybody can thank Random...okay? I'll email the account and shut down the strip and burn all remaining strips tonight.'
Random says, 'That sounds fine, Groat.'
Jim_Groat says, 'I was hoping to run a few more [years]...but hey...Random's upset...I'll not hurt his feelings anymore.'
Random says, 'You didn't hurt my feelings. You used me without permission.'
Stuka yerfs, 'Random DOES have a point. His character is copyrighted to his player. I don\'t think he's a trademark, 'tho. He's intellectual property of
his player.'
Ebola says, 'Groat...you DO email people whose characters appear in the strips, right? To notify them?'
Rustitobuck rumbles, 'Random, I wanna see the lawsuit.'.
Klaatu growls softly, 'And if you do sue Groat, I'll personally chip in money to get him the best lawyer money can buy.'
Random says, 'Who said anything about a lawsuit? I certainly didn't.'
Rustitobuck rumbles, 'Well, you were planning on backing up your big mouth with SOMETHING, right?'
Random says, 'What needs backing up, Rustybutt? I simply commented on what I felt was my character being ripped off.'
Anja would be annoyed if someone else made money off her image without her consent, but otherwise, big deal.
Shadow-Walker openly sends to all ~~{ According to copyright law, anything someone writes, or draws automatically is copyright. Since Random's
player wrote up a description, by law it's his copyright. }
Stuka yerfs, 'I think Random has a legitimate concern. I wouldn't mind if you used Stuka with permission, but he is trademarked, which is a little
different.'
Jim_Groat says, 'Nope...nobody will be used again...seems a thin skin was abraised.'
Jim_Groat says, 'Frankly I really don't care either.'
Jim_Groat says, 'Besides...Random...YOU suggested that strip of YOU being chased and threatened...guess that pissed you off too eh?'
Random says, 'I gave you the idea, but I never in any form gave you permission to profit off it. I was laboring under the impression that it was a free
not-for-profit webcomic.'
Random says, 'If you sell/trade/whatever my property, you owe me some compensation. If you took my car without asking and sold it, you would
go do jail, right?'
Kuo [who purchased the original art in question] pokes Random. 'Tell ya what. Ah will SEND you th' fscking comic if yer panties are so inna ball about
this, K? Ah wil sacrifice my money t' please you. How's that grabya?''
Jim_Groat says, 'I'll not have another Bruce on my hands. He tried to pull the same stunt...it cost me a few hundred [bucks] to find out he was full of it.'
Shadow-Walker thinks the solution, is to send Random the original strip, burn all copies and delete any electronic versions.
Jim_Groat already has torn up the strips that were to follow.
Jim_Groat says, 'Kuo...you send him that strip, I'll send back the markers.'
Random says, 'To be perfectly honest, Groat, Kuo, I don't really want the strip. That wasn't the point. I just don't like being used for another's gain
without so much as to be asked about it.'
Jim_Groat says, 'Random...the WCotP web site costs me....the strip costs me...unless somebody like Kuo tosses a bribe or a gift at me...I get squat for
it.,'
Maxie must agree that in principle, one should get permission before reusing anyone else's character, whether for profit or not.
Jim_Groat says, 'I've had it...I get bitched at because i don't use certain people, I get bitched at because I missed a detail...I get bitched at cause the
strip is a day late.'
Random says, 'Well, I have no intention of taking this matter to a court. I just felt a need to express my opinion. Whatever action you take, is up to
you.'
Rustitobuck rumbles, 'Groat, you taking the strip offline?'
Jim_Groat says, 'Yes.'
Rustitobuck rumbles, 'May I have permission to run a retrospective [of your comics] later on?'
Jim_Groat says, 'No.'
Lynx's sorry to hear that, Groat... 'Maybe you should try a different comic with your own characters? Your art style seems to go well with comic
strips.'
Random says, 'I feel ever so guilty for not being someone's patsy.'
Peg mmms. 'It's going off as of this very moment, eh?'
Jim_Groat says, 'I emailed the kill request.'
Peg says, 'To whoever's maintaining the site for you? Mmmf.'
Shadow-Walker holds up a cup, 'To the WCOTP strip. The best dammed furry strip ever.
Random says, 'Well, no big loss. It wasn't a funny strip at all.'
Jim_Groat shakes his head...he just knew he shouldn't have logged on...he should have continued to draw instead...stay away and draw..
Klaatu growls softly, 'Sorry you got dragged into this crap Groat.'
Tylyddar chirrs, ' I'm sorry to see this battle... was hoping at some point in the future to see my character in the 'west corner' strip :('
Jim_Groat says, 'Lynx....@toad...request now.'
Jim_Groat pulls out a hand grenade and holding it over his head yells 'Hear me Moshe Dayan!' and pulls the pin. There is a loud pop then a bang and
those on the immediate area have to pick bits of aardvark out of them.
Jim_Groat has left.
